STJ SUSPENDE SENTEÇA QUE IMPEDIA O REGISTRO DE MEDICAMENTOS GENÉRICOS

STJ OVERRULES DECISION THAT IMPEDED REGISTRATION OF GENERIC DRUGS

Minister Felix Fischer of the Supreme Court ruled that the National Health Surveillance Agency ("ANVISA"), must resume the provision of records for generic and similar antidepressants based on the active ingredient, escitalopram.

The Supreme Court's decision overruled the decision of the Federal Court of the ederal District which had prevented ANVISA from granting records not authorized by Lundbeck Brazil, the labratory responsible for producing Lexapro. The Court also ruled that federal records obtained by the companies Biosinética Aché Pharmaceutical Labratories and Biosynthetic Pharmaceuticals, manufacturers of similar drugs, were declared invalid.

In view of the Supreme Court, it is the multiplying effect of rash judgments of identical content which, without proper res judicata, may cause hindrance to the production of generic medications. Therefore, the suspension of that sentence is recommended to avoid, especially, the weakening of public policy for generic medications.

O Supremo Tribunal de Justiça, através do ministro Felix Fischer, determinou que a Agência Nacional de Vigilância Sanitária (ANVISA), retome a concessão de registros para medicamentos antidepressivos genéricos e similares baseados no princípio ativo escitalopram.

Esta determinação do STJ suspende a decisão da Justiça Federal do Distrito Federal que havia impedido a ANVISA de conceder registros não autorizados pela Lundbeck Brasil, o laboratório responsável pela produção do Lexapro. A decisão da corte federal determinava ainda que os registros obtidos pelas empresas Aché Laboratórios Farmacêuticos e Biosinética Farmacêutica, fabricantes de medicamentos similares, fossem declarados nulos.

Na visão do STJ, é temerário o efeito multiplicador de decisões judiciais de igual teor que, sem o devido trânsito em julgado, possam ocasionar impedimento para a produção de medicamentos genericos. Portanto, a suspensão da referida sentença é recomendável para evitar, sobretudo, o enfraquecimento da política pública dos medicamentos genéricos.
