PPH UMA ALTERNATIVA PARA REDUÇÃO DO BACKLOG DE PATENTES

PPH: AN ALTERNATIVE TO REDUCE PATENT BACKLOGS

Seeking alternatives in order to reduce its "backlog" and speed up patent examination, the Mexican Institute of Intellectual Property ("IMPI") launched Accelerated Patent Procedures ("PPH" - Patent Prosecution Highway) in conjunction with the U.S. Patent and Trademark Office ("USPTO") in March 2011.

This mechanism is a practice that is beginning to spread around the world. PPH began with the agreement between the USPTO and the Japanese Patent Office ("JPO") in 2006 and now has a membership of over 12 patent offices, including the European Patent Office ("EPO").

With these agreements, the offices benefit from work done previously by the firm that has an agreement. Thus, patent examination through the PPH will enable users to obtain the grant of patent registrations more quickly.

Buscando alternativas para reduzir seu “backlog” e dar maior celeridade ao exame de patentes, o Instituto Mexicano de Propriedade Industrial (IMPI) lançou o Procedimentos de Patentes Acelerado (PPH – Patent Prosecution Highway) em conjunto com o Escritório Americano de Marcas e Patentes (USPTO – U.S. Patent and Trademark Office) em março de 2011.

O mecanismo é uma prática que começa a se difundir ao redor do mundo. O PPH teve seu início no acordo firmado entre o USPTO e o Escritório Japonês de Patentes (JPO) em 2006, e agora já conta com a adesão de mais de 12 escritórios de patentes, incluindo o Escritório Europeu de Patentes (EPO).

Com estes acordos, os escritórios se beneficiam dos trabalhos realizados anteriormente pelo escritório com que possui convênio. Deste modo, o exame de patentes através do PPH permitirá que os usuários obtenham a concessão do registro de patentes de forma mais célere.
