JUSTIÇA FEDERAL GARANTE SEGURANÇA À PRODUÇÃO DE MEDICAMENTOS GENÉRICOS

FEDERAL COURT ENSURES SECURITY FOR PROTECTION OF GENERIC DRUGS

The Brazilian Intellectual Property Office's ("INPI") rescission act was held valid in the first trial conducted by the Specialized Section of the Federal Court of the 2nd Region in Rio de Janeiro. This overturns a decision, filed in 1993, that forced the institute to analyze the application to register a patent related to the drug Gemzar.

In the view of the INPI, when considering cases like this, one need only review the "pipeline mechanism" application, created by the Industrial Property Law (Lei 9279/96). The pipeline mechanism also concerns the protection of pharmaceutical products and processes proceeding the term of this Law. In the case of the drug Gemzar, the laboratory manufacturer did not perform the request for protection by means of the pipeline and, therefore, had its application rejected because the aforementioned legislation precluded the protection of innovations related to medicines.

INPI's argument was confirmed by the courts, giving greater security to generic drug production, and expanding public access to treatment.

No julgamento realizado pela 1a Seção Especializada do Tribunal Regional Federal da 2a Região, no Rio de Janeiro, foi considerada procedente a ação rescisória do INPI, que derruba a decisão que obrigava o instituto a analisar o pedido de registro de patente ligada ao medicamento Gemzar, depositada em 1993.

Em casos como este, segundo o entendimento do INPI, só poderia haver analise do pedido caso o requerente recorresse ao mecanismo do pipeline, criado pela Lei de Propriedade Industrial (Lei 9279/96), que versa sobre a proteção de produtos e processos farmacêuticos anteriores a vigência da referida Lei. No caso do medicamento Gemzar, o laboratório fabricante não realizou a solicitação de proteção por meio de pipeline e por isso teve seu pedido indeferido, uma vez que a legislação anterior impedia a proteção de inovações relacionadas a medicamentos.

O entendimento do INPI foi confirmado pela Justiça, conferindo aos medicamentos genéricos maior segurança à sua produção, além de ampliar o acesso do público ao tratamento.
