COLLABORATIVE PATENT EXAMINATION BETWEEN PROSUR NATIONS
Collaborative patent examination will begin in August of this year between the South American countries that are a part of the Prosur project. During a meeting held on July 14, 2011, at the Brazilian Intellectual Property Office ("INPI") headquarters in Rio de Janeiro, the decision was made which is said to speed up patent examinations in the region. The meeting was attended by representatives from Argentina, Brazil, Chile, Ecuador, Paraguay, Peru, and Uruguay.
The collaborative analysis of trademarks will be included in the next stages of the project and will rely on financing from the Inter-American Development Bank ("BID"). The project will also include Columbia and Suriname. The countries will select 300 patent applications that concern biotechnology and mechanical engineering and will transport them to the CASE WIPO system of the World Intellectual Property Organization (WIPO). This will allow each country to examine the applications selected. Also beginning in August, in addition to this work, there will also be over 300 applications in the areas of electronics and pharmaceuticals. In this testing phase, experts from each country will exchange information about the examination through an online platform. This form of collaboration will help the tests become of higher quality and faster.
In Ecuador at the end of November, the issue of collaborative analysis of trademarks will be placed on the agenda and the results obtained in the first stage of the project will be evaluated.
Vão começar em agosto deste ano as ações de exame colaborativo de patente entre os países Sul-Americanos que fazem parte do projeto Prosur. A decisão que irá contribuir para acelerar os exames de patente em toda a região foi tomada durante reunião no dia 14 de julho de 2011, na sede do INPI, no Rio de Janeiro, com representantes de Argentina, Brasil, Chile, Equador, Paraguai, Peru e Uruguai.
A análise colaborativa de marcas será incluída nas próximas etapas do projeto, que também inclui a Colômbia e o Suriname, além de contar com o financiamento do Banco Interamericano de Desenvolvimento (BID).Os países selecionaram 300 pedidos de patentes nas áreas de biotecnologia e mecânica e irão transpô-los a base do sistema WIPO CASE, da Organização Mundial da Propriedade Intelectual (OMPI), permitindo que cada país examine os pedidos selecionados. Além de trabalhar, também a partir de agosto, com mais 300 pedidos das áreas de eletrônica e farmacêutica.Nesta fase de testes, os especialistas de cada país vão trocar informações sobre o exame através de uma plataforma online. Tal forma de colaboração contribuirá para tornar os exames mais céleres e com maior qualidade.
Visando avaliar os resultados obtidos nesta primeira etapa do projeto, será realizada uma reunião no fim do mês de novembro, no Equador, quando a questão da análise colaborativa de marcas será colocada em pauta.
