REFORM OF BRAZILIAN COPYRIGHT ACT ON THE WAY

Open consultation to amend the Brazilian Copyright Act (Federal Law 9.610/98) has reached its final lap. The plan began with a series of studies and conferences (2006-2009) during former President Lula's mandate to develop a national policy for culture and copyright, about 5 years after the idea was first launched in 1998. The studies and conferences lasted until June 14, 2010, when the bill's first draft was made available and was presented to the public after an online consultation which solicited 8 thousand responses. One large matter of concern in the planned reform is the Central Bureau of Collection and Distribution ("ECAD's") recent scandals which have been the result of the Parliamentary Commission of Inquiry ("CPI's") investigation into ECAD’s allegedly irregular activities.

Recently, there have been changes in the political atmosphere surrounding the Ministry of Culture. After President Dilma Rousseff took office on January 1st, 2011, she named Mrs. Ana de Hollanda the new Minister of Culture which resulted in alterations to the bill. This was protested by 130 Brazilian musicians, composers, and artists lead by the Professional Musicians Union of Rio de Janeiro and by the Brazilian Association of Independent Music ("ABMI"). Protestors urged the government to find and third way out of the copyright reform deadlock, ensuring payment to creators without criminalizing user downloads. Protests took place again early this year (April 21, 2011), when an open letter with more than 2 thousand signatures from academics, artists, producers, the internet community, and culture activists was sent to President Rousseff. The letter expressed their discomfort with the shift on cultural policy taken by the current administration and demanded an open, transparent, and democratic cultural policy.

According to the current schedule, the Ministry of Culture has until mid-June to draw up the final draft of the bill and submit it to the Inter-ministerial Group for Intellectual Property (GIPI), which is in charge of making the final adjustments to its text. On the 15th of July, the bill will be sent to the Casa Civil by the Minister of Culture.

A consulta aberta para a alteração da lei de direitos autorais brasileira (Lei Federal 9.610/98) atingiu sua última etapa. Cinco anos após o seu lançamento em 1998, o projeto de alteração da lei de direitos autorais brasileira que começou durante o mandato do ex-Presidente Lula com o desenvolvimento de uma política nacional para a cultura e direitos de autor, e uma série de estudos e conferências (2006-2009) até 14 de Junho de 2010, quando o primeiro projeto de lei foi colocado à disposição e apresentado para o público através da consulta on-line, recebendo cerca de 8 (oito) mil propostas. Um grande ponto de preocupação na reforma prevista são os escândalos recentes do Escritório Central de Arrecadação e Distribuição (ECAD), que resultou na proposta de Comissão Parlamentar (CPI) para investigar as atividades da entidade.

Mudanças recentes no cenário político em torno do Ministério da Cultura, depois da posse da Presidente Dilma Rousseff, Ana de Hollanda foi nomeanda Ministra da Cultura, resultaram em alterações no projeto de lei, seguida pelo protesto de 130 músicos, compositores e artistas brasileiros conduzidos pela Associação Brasileira da Música Independente (ABMI), cobrando do governo uma alternativa para resolver o impasse na reforma da lei dos direitos autorais, assegurando o pagamento aos autores, sem no entanto criminalizar o usuário final do download. Protestos foram realizados, novamente, no início este ano (em 21 de abril) quando uma carta aberta com mais de 2 (duas) mil assinaturas de acadêmicos, artistas, produtores, a comunidade da internet e ativistas de cultura foi enviada a Presidente Rousseff evidenciado a insatisfação com a mudança na política cultural tomada pela atual administração e exigindo uma política cultural aberta, transparente e democrática.

De acordo com o cronograma atual o Ministério da Cultura tem até meados de Junho, para elaborar o projeto final do projeto de lei e submetê-lo ao Grupo Interministerial de Propriedade Intelectual (GIPI), encarregado de fazer os ajustes finais ao seu texto. Em 15 de Julho o projeto de lei será enviado para a Casa Civil pela Ministra da Cultura.
